Next Keystone XL Deadline Is Feb. 2

February 2 is the deadline for parties participating in the Keystone XL pipeline proceedings at the South Dakota Public Service Commission to submit reply briefs.

The purpose of these briefs is to respond to the briefs and proposed rulings that were submitted last month. TransCanada proposed the ruling it would like the PUC to make.

TransCanada’s proposed ruling may be the source of some confusion about deadlines. TransCanada suggests that PUC should issue its decision at a PUC meeting sometime this month. However, under South Dakota law, the Commission has one year from receipt of TransCanada’s application. TransCanada filed its application on March 12, 2009.

This is significant. The Commission has repeatedly said that the public can submit comments until it makes its decision. If you are planning on sending comments but haven’t yet, you should act now. No one other than the SD PUC itself knows if the Commissioners will wait the full year to rule or if they will take TransCanada’s suggestion and rule this month.
